1. What is an Industrial Design?

An industrial design is defined in Section 2 of the Industrial Design Act (R.S.C. 1985, c.19, as amended) as the "features of shape, configuration, pattern or ornament and any combination of those features that, in a finished article, appeal to and are judged solely by the eye." This definition of an industrial design is concise, but it does not explicitly address many of the important considerations which will determine whether your design can be protected by an industrial design registration. In the following subsections we will delve further into these considerations.
